Separate the issues from the history
A short issue map can distinguish what happened, what is agreed, what remains contested and what each party needs next. This reduces the risk that every new discussion simply repeats the entire history. It also identifies questions that need legal or technical advice before negotiation can progress.
Design a conversation people can use
Clarify the purpose of the meeting, who will attend and how proposals will be considered. Participants may need time to consult a board, insurer or adviser. Our practical reading of the evaluation is that clear expectations deserve attention alongside the choice of process.
Measure progress in practical terms
Progress can include a narrower list of disputed points, an agreed exchange of information, a better understanding of settlement options or a documented agreement. If court proceedings are already underway, the relevant legal advisers should continue to manage deadlines and procedural obligations.
